Welcome to Synctech Solutions GmbH (“Emico-IS”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and any related platforms (collectively, the “Service”).

3. Payments

3.1 Billing

5. Pricing and Refunds

We reserve the right to modify pricing under exceptional circumstances. Any changes will be communicated to you in advance.

5.3 Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

6. Service Availability and Disclaimer

6.1 Availability
We strive to provide a reliable and uninterrupted Service but do not guarantee continuous availability.

6.2 Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • merchantability
  • fitness for a particular purpose
  • non-infringement

7. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits.
  • Our total liability for any claims arising out of or relating to the Service shall not exceed the greater of:
    • €20, or
    • the total amount paid by you in the 12 months preceding the claim.

8. Dispute Resolution

8.1 Informal Resolution
Before initiating legal proceedings, you agree to contact us to attempt to resolve the issue amicably.

8.2 Governing Law and Jurisdiction
These Terms are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.

9. Intellectual Property

9.1 Ownership
All content, trademarks, and intellectual property associated with the Service remain the property of Synctech or its licensors.

9.2 Infringement Claims
If you believe that content on our platform infringes your intellectual property rights, please contact us with sufficient details.

9.3 Enforcement
We reserve the right to remove infringing content and terminate accounts of repeat offenders.

10. Modifications to the Terms

We may update these Terms from time to time. Changes will be posted on our website and communicated via email where appropriate.

Continued use of the Service after such updates constitutes acceptance of the revised Terms.

We reserve the right to remove content or suspend services if, in our sole discretion, a violation occurs.

Violations may result in immediate suspension or termination of your account.

If you believe your copyright has been infringed, you may submit a notice including:

  • Your signature (physical or electronic)
  • Identification of the copyrighted work
  • Identification of the infringing material and its location
  • Your contact details
  • A statement of good faith belief
  • A statement of accuracy under penalty of perjury

5. Reporting Violations

To report violations of this AUP, please provide:

  • Date and time (including time zone)
